1. Scope of Work
Sunquell agrees to perform professional window tinting services at the address listed in the quote.
2. Timeline
Residential jobs are usually completed within one day. Commercial job timelines vary. The client agrees to provide access to the property on the scheduled date.
3. Pricing & Payment
A 50% deposit is required and due 7 days prior to the start of the job. Full payment of the remaining balance is due within 3 days of invoice issuance, unless otherwise agreed to in writing. Failure to pay may result in legal action, including the registration of a construction lien against the property under the Ontario Construction Act.

Cancellation Policy
All deposits are strictly non-refundable. If the client cancels for any reason, or fails to provide access to the property on the scheduled installation date, the deposit is forfeited in full. If Sunquell is unable to proceed on the scheduled date due to circumstances within its control, the deposit will be refunded in full or the booking rescheduled at the client's preference.
Please note: paying with a credit or debit card may result in a 3% processing fee.
4. Warranty
Sunquell provides a 10-year limited workmanship warranty covering defects resulting directly from installation errors, including peeling, bubbling, or film failure caused by improper application.

Sunquell's workmanship warranty is capped by the manufacturer's product warranty period for the specific film installed. Where Madico's product warranty for the installed film is shorter than 10 years, Sunquell's workmanship warranty is limited to that same period. For example, exterior-designated films carry a 3-year Madico product warranty; accordingly, Sunquell's workmanship warranty on those installations is limited to 3 years. Film failures occurring after the applicable Madico product warranty period has expired are considered product degradation and are not covered under Sunquell's workmanship warranty, regardless of installation quality.
Every effort is made to achieve the cleanest possible finish; however, environmental factors such as airborne dust and other contaminants may occasionally affect results. Any pane with an error rate¹ exceeding 3% of its surface area is covered and will be remedied at no additional charge. Please note that films installed on exterior glass surfaces are exposed to greater environmental variability and carry a higher probability of contaminants.
¹ Error rate: the percentage of a pane's surface area affected by imperfections in film adhesion or finish, including contamination (e.g., dust particles or debris trapped beneath the film).
† Exterior-designated films only. Films are warranted for installation on interior, vertical, flat glass surfaces unless specifically designated for exterior use.

Glass breakage and seal failure coverage applies only to product lines where indicated above. All manufacturer warranties are non-transferable and apply to the original purchaser unless otherwise specified by Madico.
Warranty Exclusions
The following are not covered under either Sunquell's workmanship warranty or Madico's manufacturer warranty:
- Damage caused by misuse, abuse, or improper cleaning — including the use of ammonia-based products, abrasive cloths, or sharp tools
- Normal wear and tear from environmental exposure
- Pre-existing glass damage, including chips, cracks, or failed insulated glass seals not disclosed prior to installation
- Compatibility issues arising from specialty glass types (e.g., tempered, wired, or low-e coated glass) not disclosed by the client prior to installation
- Glass breakage claims on product lines where Madico's warranty does not include glass breakage coverage (see table above)
- Any tampering with, unauthorized removal of, or modification to the film after installation by anyone other than a Sunquell technician
5. Liability Disclaimer
While Sunquell takes every reasonable precaution to protect your property during installation, we are not responsible for:
- Pre-existing window damage including chips, cracks, or failed seals
- Compatibility issues with specialty or non-standard glass types not disclosed by the client prior to installation
5A. Security Film Disclaimer
Security window films installed by Sunquell are designed to strengthen glass and delay forced entry — not to fully prevent break-ins or eliminate the risk of property damage or theft. Effectiveness depends on variables including glass type, film thickness, edge retention method (e.g., mechanical anchoring or caulking), and the force applied during an intrusion attempt.
Sunquell is not liable for any loss, damage, or injury resulting from a breach of glass on which security film has been installed. Clients are advised to treat window film as one component within a comprehensive, layered security approach.
6. Industry Standards & Installation Framework
Sunquell Window Tinting Inc. follows the installation guidelines and quality standards established by the International Window Film Association (IWFA) — the primary trade organization for the window film industry. The IWFA develops and maintains best practices covering all aspects of professional window film installation, from surface preparation through post-installation care.
By adhering to the IWFA's installation framework, Sunquell ensures that every residential and commercial job is completed to a recognized industry standard. Our commitment to these guidelines includes:
- Thorough surface preparation prior to film application, in accordance with IWFA best practices
- Use of proper tools, application solutions, and techniques to minimize distortion, contamination, and adhesion issues
- Post-installation care and curing protocols consistent with IWFA-recognized standards
- Ongoing adherence to IWFA quality benchmarks for both residential and commercial installations

7. Entire Agreement
This document constitutes the complete agreement between the Client and Sunquell Window Tinting Inc. Any modifications must be made in writing and signed by both parties.
Governing Law
This agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.
Acknowledgement & Signature
By agreeing to the job, booking an installation date, or submitting a deposit, both parties acknowledge and agree to the terms outlined in this agreement.
8. Photo & Marketing Release
Sunquell reserves the right to photograph completed installations for use in its portfolio, website, social media channels, and other marketing materials. Photography will be limited to the treated windows and immediate surroundings; no personally identifiable information (such as house numbers, names, or faces) will be published without the client's explicit consent.
Clients who wish to opt out of photography must notify Sunquell in writing prior to the scheduled installation date.
9. Force Majeure
Sunquell shall not be held liable for any delay, cancellation, or failure to perform arising from circumstances beyond its reasonable control, including but not limited to extreme weather conditions, natural disasters, acts of government, supply chain disruptions, or other events of force majeure. In such circumstances, Sunquell will make reasonable efforts to reschedule the affected installation at the earliest available opportunity and will communicate any changes to the client promptly.
Post-Installation Care
Please follow these guidelines to protect your film during the curing period and to keep your warranty valid:
- Avoid cleaning windows or placing pressure against them for 7 days after installation.
- For thicker security films (8 mil and above), extend the no-cleaning period to a minimum of 10 days.
- Where anchoring systems such as caulking are used, do not disturb the edges for at least 72 hours.
- Minor haziness or small bubbles may appear during curing and will typically resolve on their own. If any bubbles or haze have not cleared within 60 days of installation, the client is entitled to request a review, at which point Sunquell will assess the affected panes and determine whether re-installation is warranted at no charge.
- Use only soft, lint-free cloths and non-ammonia cleaning solutions. Use of ammonia-based cleaners will void your warranty.
